Terms of Service

Last updated: March 2026. These Terms govern your use of haived.com.

1. Acceptance of Terms

By creating an account or using haiv in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform.

We may update these Terms at any time. We will notify you of material changes by email with at least 14 days' notice. Continued use after the effective date constitutes acceptance.

2. Description of Service

haiv provides an AI-powered software development platform. AI agents assist in writing, reviewing, running, and deploying code inside isolated cloud containers. Projects run on your chosen OS, stack, and resources.

The platform is currently in beta. Features may change, and we do not guarantee uninterrupted availability.

3. Eligibility

You must be at least 16 years old to use haiv. By registering, you confirm that you meet this requirement and that the information you provide is accurate. Business accounts must be created by an authorised representative.

4. Account Registration & Security

You agree to:

  • Provide accurate and complete registration information
  • Keep your password and credentials confidential
  • Not share your account with any other person
  • Notify us immediately of any unauthorised access at [email protected]

You are responsible for all activity that occurs under your account. We are not liable for losses arising from unauthorised use of your credentials.

5. Acceptable Use

You may not use haiv to:

  • Create, store, transmit, or distribute illegal content
  • Infringe the intellectual property rights of any party
  • Attempt to access other users' data or containers
  • Reverse-engineer, decompile, or scrape the platform or its APIs
  • Launch attacks (DDoS, brute-force, etc.) against any system from containers
  • Send spam, conduct phishing campaigns, or distribute malware
  • Mine cryptocurrency or perform resource-intensive work unrelated to software development
  • Violate any applicable law or regulation

Violation of these rules may result in immediate suspension or termination of your account without prior notice and without refund of unused credits.

6. Credits & Billing

  • haiv operates on a prepaid credits model. You top up your balance before consuming services.
  • Credits are consumed for LLM token usage and compute time as shown in your dashboard.
  • Credits are non-refundable except where required by applicable EU consumer law.
  • Prices are listed in your account and may change with 30 days' prior notice.
  • We reserve the right to suspend service if your credit balance reaches zero.

7. Intellectual Property

Your content: You retain full ownership of all code, files, data, and other content you create or upload using haiv. We claim no ownership or licence over your project files or generated code.

Our platform: haiv, its branding, trademarks, and underlying platform code remain the exclusive property of haiv. You may not copy, modify, or distribute the platform software.

By using the platform, you grant haiv a limited, non-exclusive licence to process and store your content solely to provide the service — for example, to pass chat messages to AI providers or to store project files in containers.

8. AI-Generated Content

Code and content generated by AI agents may not be protected by copyright in all jurisdictions, as laws on AI authorship continue to evolve. You are solely responsible for reviewing, testing, and ensuring the correctness and legality of any AI-generated output before use in production.

AI agents may make mistakes. haiv is not responsible for errors, omissions, or security vulnerabilities in AI-generated code.

9. Disclaimer of Warranties

haiv is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable EU law, haiv shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or service unavailability, arising from your use of or inability to use the platform.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the platform shall not exceed the total amount you paid to haiv in the three (3) months immediately preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Termination

By you: You may delete your account at any time from your profile settings. Upon deletion, your project containers and personal data will be removed within 30 days, subject to legal retention requirements.

By us: We may suspend or terminate your account immediately for material breach of these Terms, non-payment, or actions that harm the platform or other users. We will notify you unless prohibited by law. Unused credits may be refunded at our discretion.

Projects in suspended accounts will be kept for up to 7 days before deletion, during which you may contact us to recover your data.

12. Governing Law & Disputes

These Terms are governed by the laws of the European Union and the applicable member-state law where haiv is registered. Any disputes that cannot be resolved by mutual agreement will be subject to the exclusive jurisdiction of the courts of the applicable EU member state.

EU consumers retain the right to use the online dispute resolution platform provided by the European Commission at ec.europa.eu/consumers/odr.
